Prague’s municipality levy charges for information without authorization
Today was delivered the decision of The Interior Ministry to The League of Human Rights, which states the misconduct of the Municipality of the capital city of Prague in handling the requests for information that refers to the number of independently working midwifes.
The League disagrees with having to pay a clerk to search the information which costs 200 CZK in accordance with the tariff scale (100 CZK for the first 15 minutes, 2 x 50 CZK for every other 15 minutes) and a postal charge for a registered letter in the amount of 36 CZK. League requested this kind of information from various other regions and none of them charged such a fee for searching the information. For this reason, The League supposed that charging this kind of fee is not in conformity with the due course of public administration.
At first, The Ministry agreed with The League that the obliged person may demand payment for posting the information but not for posting other written statements connected to the proceedings like in this case. As for the fee for the work of the clerk who searches for the information, the statute states that the office may demand such a fee only in case of “an extraordinary deep search for information”.
The Ministry further specifies the term of an extraordinary deep search for information: “This kind of fee would be demanded typically in cases when granting the information is connected with searching and processing a lot of information, or if the subject of the request is so general that it is possible to assign to it much related information. The extraordinary deep search for information would be predicted also in the case when the subject of the request is concrete enough, but the providing of the information would demand broader activity of the obliged personality because of another factual circumstance (e.g. in case of an old information)”.
