Mother suffering from mild mental condition enjoys full legal capacity to take care of her children
The Jicin District Court has, at last, decided on the case of mother whose son was placed into institutional care due to her mild, psychiatric condition. Liga is currently working towards obtaining compensation for damages caused to the woman, Mrs. D.
Mrs. D has been suffering from a mild psychiatric disorder for many years and, on this basis, the District Court made a preliminary ruling in that Mrs. D’s youngest child should be placed into institutional care.
Liga adopted Mrs. D’s case in November 2006, shortly after her son was taken into care. The case was managed by one of Liga’s lawyers, working on Liga’s project; ‘preventing the increase of institutionalized children’. Liga’s lawyer was highly successful in this case, not only in convincing the Judge to reverse the preliminary ruling, but also in persuading the Judge to rule for the discontinuance of any further civil proceedings in this case. Mrs. D’s son was kept institutionalised for approximately ten months in total.
Unfortunately, the Court then instigated new proceedings, dealing with the legal capacity of Mrs. D in regards to her parental responsibility. Luckily, these proceedings were halted by the same court, on the basis of a submitted expert’s report.
